Dear Consumer Protection Investigator,
I am submitting this comprehensive complaint on behalf of all impacted tenants against Rose Hall Apartments and its billing agent, National Exemption Service (NES), to seek urgent regulatory review and enforcement action for a pattern of widespread violations of the Virginia Residential Landlord and Tenant Act (VRLTA) and the Virginia Consumer Protection Act.
I. Executive Summary
The attached report documents a persistent, multi-year pattern of billing misconduct targeting tenants, including chronic overcharging, misapplication and delay of payments, non-transparent ledgers, and unlawful escalation of penalties. This has resulted in artificial arrears, injury to tenant credit, and improper threat or commencement of eviction—all for account issues manufactured or improperly managed by Rose Hall and NES.
II. Key Statutory Violations Documented
- Recurrent imposition of $10 or stacked $5 late fees exceeding VRLTA §55.1-1212(D) caps, irrespective of actual delinquency or account credits.
- Routine account handling in which even fully paid or credit-balanced tenants are kept in a perpetual state of “arrears,” violating §§55.1-1209 and 55.1-1213, and impeding tenants’ rights to clear accounting.
- Systematic failure to honor the 21-day statutory cure and redemption window as required by §55.1-1245 and §55.1-1250, instead issuing instant penalty notices and escalating to eviction threats.
- Rolling of water/sewer utility balances into the rent ledger—leading to multiple penalties for a single missed payment—contrary to the requirements for separate, itemized billing (§55.1-1212) and fair debt collection.
- Issuance of defective notices that omit lawful statutory protections (“pay and stay” rights), misstate legal authority, and confuse or intimidate tenants.
- Failure to provide full, itemized statements as required by §55.1-1212(B) and (C), with vague line items (“other” or “previous charges”) substituting for transparent ledgering.
- Automated fee assessments and “rubber-stamp” penalty processes, regardless of payment date/history, showing either deliberate indifference or automation abuse contrary to §59.1-200(A)(14) (deceptive or unconscionable acts).
III. Harm to Tenants and Public Interest
- Tenant balances are never cleared, large payments are misapplied, and account “arrears” are artificially maintained, harming creditworthiness and access to housing.
- Tenants are denied due process rights to cure or dispute charges, with eviction threats based on defective or illegitimate notices.
- Seniors and vulnerable residents are especially susceptible to misleading billing and “friendly reminders” that hide aggressive penalty practices.

V. Defenses Anticipated and Addressed
Rose Hall may blame automation or system error (“auto bill pay” disruption, 2025); however, their systemic practices predate any single account event and affect a broad tenant base. Reliance on auto-pay cannot excuse disregard for legal fee caps, cure rights, or transparent recordkeeping.

- Immediate investigation into billing, accounting, and notice practices at Rose Hall Apartments.
- Regulatory enforcement, including injunctions on improper billing and notice practices.
