To the Honorable Judges of the Circuit Court for the City of Virginia Beach:
I respectfully submit the enclosed Petition for Proceeding in Civil Case Without Payment of Fees or Costs (Form CC‑1414)
and supporting documentation, and ask the Court to permit me to proceed in this civil action without prepayment of filing
fees and costs. I am appearing pro se and am doing my best, without counsel, to comply with the Virginia Code, the
Supreme Court of Virginia forms, and all applicable local rules and procedures.
Because of my limited income and necessary living expenses, I am unable at this time to pay the filing fees and related
costs in this case without sacrificing basic necessities such as housing, utilities, food, transportation, and medical care.
The information in Sections A, B, and C of Form CC‑1414 reflects my current income, assets, household size, and
exceptional expenses to the best of my knowledge and belief. I understand that by signing the petition I am certifying
the truth and completeness of this information under penalty of perjury, and I have carefully reviewed the form for
accuracy before presenting it to the Clerk and to the Court.
I prepared the fee waiver petition using the Virginia Do‑It‑Yourself Court Fee Waiver Form Online System
available through VaLegalAid.org, an initiative of the Virginia Poverty Law Center (VPLC). This self‑help
tool is provided free of charge to low‑income Virginians and is designed to generate the standard statewide Form
CC‑1414 for filing in Virginia courts. I understand that the program does not file documents on my behalf, that this
petition cannot be submitted electronically, and that the Court must receive a signed paper copy along with any
supporting documentation for its independent review.
In support of my request, and in accordance with the published instructions for Form CC‑1414 and the Virginia Judicial
System’s self‑help guidance on filing fees and waivers, I have enclosed copies of any available documentation of my
financial situation, including recent pay stubs or proof of public benefits (if any), bank statements or other evidence of
liquid assets, and records of exceptional expenses such as medical bills, support obligations, child‑care costs, and other
ongoing necessary obligations. Where the space on the form was insufficient to explain my circumstances, I have
provided an addendum describing my income, debts, and extraordinary expenses in more detail, as recommended.
I understand that the Court has discretion to grant or deny this petition, that the decision is generally based on my
income, assets, household size, and necessary expenses, and that if the request is denied I may be required to pay the
applicable fees before this matter can proceed. If the petition is denied and the decision appears to rest on a
misunderstanding of my financial circumstances, I respectfully request the opportunity, if appropriate, to seek
reconsideration so that the Court has a complete and accurate picture of my situation.
This civil action—seeking declaratory, injunctive, sanctions, and supervisory relief concerning writs of possession and
eviction issued in General District Court case GV25037264‑00 and the associated enforcement‑without‑judgment
sequence documented in the Odyssey case management system—is of great importance to me, and I am pursuing it in
good faith. Without a waiver of fees and costs, my ability to obtain review and relief in the Circuit Court would be
effectively blocked by financial hardship alone, despite my efforts to present a structurally proper initiating petition
and to follow the guidance provided by the Clerk’s Office and the Virginia Judicial System’s self‑help resources.
I do not seek any unfair advantage; I only ask for a meaningful opportunity to be heard on the merits of my case,
consistent with the fee‑waiver process that exists to preserve access to justice for low‑income litigants in Virginia
courts. For these reasons, I respectfully request that the Court grant my Petition for Proceeding in Civil Case Without
Payment of Fees or Costs, authorize me to proceed without prepayment of filing fees and costs in this matter, and enter
the appropriate order so that the Clerk and all court officers may provide the needful services and process in this case.
