Subject: Immediate Removal and Record Correction — Procedural Misstatement and False Classification
Ms. Brown,
You could not have read the letter. The filing submitted on October 7, 2025 was a Pre-Determination Submission –
Wage Verification, Statutory Clarification, and Record Integrity, issued before any adjudication or appeal stage.
Your office’s notation that “an appeal was received on October 8, 2025” is demonstrably false, and the record now
contains an official misrepresentation of fact.
This is a procedural breach of the highest order. The Commission has no jurisdiction to re-label a pre-determination
filing as an appeal, and no lawful authority to advance it to hearing. The action constitutes an unlawful seizure of
process and an overt disruption of due administrative sequence.
The false classification must be immediately removed from the record, the docket entry voided, and written
confirmation of correction issued without delay. Any continuation under this defective status would be knowingly
operating on a void procedural record.
This demands immediate correction—today.
Respectfully,
Thomas D. Coates
