Dear [Higher-Level Manager's Name],

I am writing to formally escalate my ongoing concerns regarding the lack of follow-through and responses to numerous important requests that have significantly impacted my payroll, absences, disability, and access to necessary records and procedures. Despite multiple attempts to resolve these issues internally, I have not received satisfactory responses or resolutions, which is causing undue stress and hardship.

This is the last correspondence I have received from Ms. Azariah Workman:

RE: [EXTERNAL] Request for Employer-Provided Leave and the Americans with Disabilities Act and request for Reasonalble Accomodations

Hello Thomas,

Thank you for your email. I acknowledge receipt of your accommodation request. We can discuss the details further when you return from your leave in September.

Azariah

The lack of timely responses and resolutions to my requests for accommodation, accurate payroll, absence records, and access to necessary systems and records is unacceptable. This has caused significant distress and has affected my ability to perform my job effectively and manage my health conditions adequately.

To ensure proper escalation, I have taken the following steps:

  1. Immediate Supervisor/Manager
  2. Higher-Level Management
  3. Formal Complaint to HR

Here is a summary of my requests and the lack of follow-through:

OCCURENCES INCREASED - CHANGES/ADDITIONS MADE WITH ERRORS

My pending request for time-off to care for my Son, in 4 days, had not received a single response. -
However, at the same time, this period was used as an opportunity to make updates which increased my occurrences and an opportunity to generate a Written ScoreCard Final Warning!

ON June 25, a WRITTEN REQUEST had been turned in concerning PAYROLL, TIME, WORKDAY, BENEFITS, DISABILITY, LEAVE, COMPUTER LOGS/TICKETS, OFFLINES, Absence Requests Absence Balance, with PENDING AND UNRESOLVED (responded-to) REQUESTS SUBMITTED, why would there be retroactive and incorrect changes made to Occurrences?

Subject: Rebuttal to Written Disciplinary Action Dated June 22, 2024

Dear Ms. DellaVecchio and Ms. Azariah Workman,
I am writing to formally contest the written disciplinary action issued to me on [date]. I believe this action is unwarranted and does not consider key information that I had previously submitted.

On [(3/26/2024, 4/1/2024, 4/5/2024, 4/23/2024, 4/30/2024, 5/7/2024, 5/14/2024, 5/18/2024, 5/19/2024, 5/20/2024, 5/21/2024, 5/26/2024, 5/28/2024, 6/3/2024, 6/4/2024, 6/8/2024)], I filed several requests that addressed the issues raised in the disciplinary action. These requests included detailed information and technical documentation regarding systems errors affecting: PAYROLL, ABSENCES, WORKDAY, ICE, ICOMS and STAR that should have been taken into account before any disciplinary measures were decided upon. Unfortunately, these requests were not answered, and the information therein was overlooked. The issues which have been documented and submitted to sales leadership have direct impact and relevance to the [Inbound Sales Performance Scorecard Policy] for May 2024, April 2024 and March 2024 and directly affect my actual attainment in meeting [the sales minimum performance thresholds in any one-month period]. ......see attached......

Dear Azariah,

I am writing to express my deep concern about the events that transpired late this afternoon and evening. Leaving your office earlier in the day, I felt hopeful that someone had heard me and that we could finally address the reporting issues I've raised for the past two months.

I understand my progress on the task you assigned may have been slower than anticipated. I apologize for any inconvenience this may have caused. Please consider the reduced capacity of my computer, as it has frequent long delays when moving between systems.

Being pulled from my desk by two managers, especially after informing them I was actively working on your request, was deeply upsetting. There was a rush and immediacy that I stop and start calling customers, particularly after telling Sarah that I had found additional mobiles and other revenue. Azariah, I can't help but feel these actions were retaliatory, particularly given my recent request for time off to care for my sick son. The subsequent flurry of negative findings, written warnings, and reports, including docked time for the emergency leave I took for my son, and the pressure to abandon the report you requested, only strengthens this feeling.

The report you assigned held the potential to clarify the situation surrounding the earlier written warning I received, which was the first thing I encountered upon returning from the day off with my family. Furthermore, the sudden insistence on immediate customer calls, after I have spent the last 3 months with a malfunctioning computer, and specifically, over 17 hours in May dealing with these issues, raises serious questions about the motives which seem to bend towards punishment and fault finding for requesting time to care for my Son.

Azariah, working in an environment like this is unsupportive and weakens my security at a time when I am most vulnerable and in need of strength. It's disheartening to believe there's little chance of receiving fair treatment moving forward.

I will be in tomorrow to complete and deliver the promised report. However, I also urgently request a one-on-one meeting to discuss a more personal perspective on the challenges I'm facing with my son's health and explore a possible transition for myself.

Thank you for your time and consideration.

Sincerely,

Thomas Coates

Donte,

Of course I think the world of you, and feel as though you have done what has been in your control to do, for the period of time when you have been assigned to me. I did want to see if you can help me get in touch with someone to talk to in HR.

Thank you Donte
